TERMS & CONDITIONS
The following terms and conditions apply to all agreements concluded by the customer (you) and the brand ROSA FAIZZAD VAT/CVR 39439433 (us) a company registered in Denmark.
By using any of our services, social media platforms, website, affiliate program and by placing an order with us in any way online or offline you accept and acknowledge that you have read and understood the terms and conditions prior placing an order.
If you do not accept our terms and conditions, please do not use our site/services or social media platforms.
Any order by persons under the age of 18 should be made with a guardian's approval.
We reserve the right to refuse an order if, e.g. you have provided incorrect information and/or if we suspect any type of fraud.
The terms and conditions that apply to you are those that you approved at the time of ordering.
CHANGE OF THE TERMS AND CONDITIONS
We reserve the right to change these terms and conditions without prior notice and amend them every often so. Any changes to these conditions will be posted on our website.
Changes will become valid once you have accepted the conditions (in connection with a new purchase or while browsing the website), alternatively 30 days after we have informed you of the changes. However, we recommend that you regularly remain updated on the Website in order to become aware of any changes to our conditions.
SALE OF GOODS AGREEMENT
An order can only be completed once the customer have accepted our terms and conditions.
This includes any order made through our website, social media platforms, by sending us an E-mail/message, through the phone and/or by visiting our showroom.
Once you have submitted your order, you will receive an E-mail in which we acknowledge that we have received your order. Please note; that this NOT an order confirmation as all orders are subject to availability and acceptance by us - which we may refuse for any given reason.
Once we’ve received your order, we will start processing it and send you a confirmation by E-mail. You will also be receiving an E-mail to inform you when your order has been dispatched & your payment has been received in full.
The confirmation will be sent to the E-mail address that you provided when placing the order, unless it is incorrect.
If for any reason we are unable to ship out your order, we will try our best to notify you by E-mail/message.
Your order is considered fulfilled as per the delivery date set by the freight company - in case of no delivery date, then as soon as reasonably possible depending of the delivery that you have selected - maximum 30 days after you have entered the sale of goods agreement with us.
If the shipping company fail to reach you at your address after 3 attempts or if you fail to pick up your order in timely manner, we reserve the right to end the contract.
After the products have been delivered to your address our responsibility will end and the delivery will be considered to be complete. The order will now be your responsibility.
ROSA FAIZZAD is the sole personal data controller and responsible for the processing of your personal data.
We process your personal data in accordance with the EU personal data law in order to be able to deliver your order or/and receive your payment.
We may also use your personal data to send marketing to you via E-mail; such as newsletters, mail with personalized and exclusive offers based on your order history and the products which you have shown interest in.
As a registered member of our website/newsletter/affiliate program, your membership is applicable to all current and future orders at ROSA FAIZZAD and your membership is valid until further notice and may be terminated by you or us at any time.

PRICES & FEES
All prices on our website and social media platforms are shown in either US Dollars and/or Danish kroner.
All our prices shown are including 25% VAT, handling and packaging fees - but excluding transaction and shipping fees.
IMPORT TAXES, DUTIES & FEES
Your order may be subject to import duties and taxes. You are alone responsible to pay any custom related levy, such as custom taxes, import duties, valued-added tax (VAT) etc. as this is not something we have any control over and is neither paid to or by us.
ROSA FAIZZAD cannot be held responsible for any tax/custom related fees and can neither give any guarantees, predict or estimate as to whether an order will or will not be required to pay customs-related taxes or fees.
Please contact your local customs office for more information.
If you are returning an order to us, please make sure that the return parcel is clearly marked with the wording: "Return to seller".
We reserve the right to make price changes at any time for any reason without prior notice.
These changes will not affect orders which have already been accepted.
We also have the right to correct any possible errors in pricing information and to any sales.
If we accept or process an order with an obvious pricing error, which could have easily been recognized by either you or us, we reserve the right to withdraw the order, end the contract and require the item to be sent back and refund any sum you have paid.
Payment for orders can be done with the following payment methods:
VISA, MASTERCARD, AMERICAN EXPRESS, MobilePay, MAESTRO, APPLE PAY, GOOGLE PAY & PAYPAL.
When making a purchase with us using card payments, please rest assured that all transaction information are encrypted and no unauthorized person can access it.
By sending us your payment, you agree that you would like to use the same payment method for any subsequent charges related to that particular purchase. These charges are limited to costs incurred in connection with returns or other costs in connection to exchanges in accordance with our current price list.
If you are awaiting a refund, it may take up to 10 business days for the refund to appear on your card statement after we have processed the case. This is to enable all parties, including the bank, to complete the transaction.
When you select the PayPal payment method at checkout, the payment is carried out directly via PayPal. Once the payment has been registered with us, your order will be posted to you.
Orders that are received and processed are usually dispatched within 2 business days.
Please expect longer time (up to 5 days) during peak/high season sales. Afterwards your local carrier may have a total transfer period of approximately 3-21 days depending on your address and the desired freight company
Your package will be delivered to your home address or to the closest carrier office.
When your order is shipped, you will receive a delivery confirmation E-mail with the relevant information and the possibility to track your order.
You will also receive an E-mail, a notification letter or an SMS informing you where to pick up your parcel.
For shipping methods which require ID documentation, we kindly ask you to present a valid ID when collecting your order.
RIGHT OF WITHDRAWAL, RETURNS & EXCHANGE
You have the right to withdraw/return/exchange your order within 30 days counted from the date you receive your order.
To exercise this right of all you have to do is, E-mail us at email@example.com and we will send you a return form that you can fill out, print, put inside the package and return the goods to us.
Please obtain proof of return in terms of receipt and please keep this receipt safe. Please do not return packages without obtaining proof.
In the return form; please specify your name, address, customer id and order number. The item(s) must be returned properly packaged and in the original packaging and condition.
Please note that all returns are made at the buyers own expense as we do NOT offer free returns/exchanges at this moment.
If you wish to exchange your ordered item(s) to a different size, please note that you must pay the return shipping.
If you wish to exercise your right to return or exchange, please return the item(s) in the original condition.
If the goods arrive in an altered condition, a deduction for any value reduction may be made on the refund amount.
Please note that in case of an exchange/return, you are responsible for the return shipping costs.
ROSA FAIZZAD will cover the return shipping cost if an item arrive damaged or is defective and we are responsible.
Therefore, should anything happen to the shipment before it arrives, please remember to keep the delivery note from your purchase together with the receipt from the postal agent where you posted your return. The freight company is usually responsible if such incidents occur.
Refunds are processed as soon as we receive the returned goods, but no later than within working 14 days. We refund using the same payment method used when you placed the order.
If a payment were made using card or PayPal, it may take up to 10 business days for the refund to appear on bank statement after we have processed the case. This is to enable all parties, including the bank, to complete the transaction.
For environmental reasons and to be able to continue to offer competitive prices and a good service, we are constantly working to reduce the amount of unnecessary returns.
If we discover an unusual pattern of purchases and returns, e.g. the return of used goods or the return of a large amount of goods repeatedly, we may deem it necessary to close an account without prior notice. If this happens to you and you believe we have made a mistake, please contact us so that we can review the situation.
ROSA FAIZZAD adheres to current consumer legislation. If the customer has received an item that is damaged or defective, please notify us as soon as you discover the defect. Notifying us within 2 weeks of discovering the defect is considered to be an acceptable time period.
In the case of damage during transport or a missing item, please contact us immediately.
ROSA FAIZZAD strives for the highest level of customer satisfaction and will do our best to satisfy our customers.
If our products fail to meet your expectations, please contact us before leaving a negative review and we will do our utmost best to offer you a satisfactory solution.
If you have a discount code that entitles you to receive a discount please use this within the discount period date. Only one discount code can be used at the check out and these discount codes cannot be exchanged for cash.
All offers and sales are applicable for a limited time frame. Please make sure to place your orders in a timely manner to ensure that you benefit from the offer/sale.
PRODUCT INFORMATION & IMAGES
ROSA FAIZZAD strive to display its products as accurately as possible. This includes e.g. color rendering and measurements.
All images are solely for illustrative purposes and informations should be considered as a guideline only as we cannot guarantee that images are an exact representation of the product since color rendering may vary depending on lighting, your particular device, screen settings, printing, which is why we cannot guarantee that the colours of the products will be a 100% representation for the products that you will receive.
Garment dimensions are approximate and should be also considered as a guideline and not 100% translatable to the actual dimensions of the garment, as all measurements are taken manually. An error margin of 2-5 cm is therefore acceptable and cannot be considered faulty.
Moreover fittings may vary depending on your height and body shape.
Product description is solely meant as an inspiration and as a guideline. We cannot not be held responsible for any inaccuracies in the product descriptions.
We reserve ourselves for any textual or image errors as well as product specification errors on all products in the range and reserve the right to sell out of a product or a size at any given time.
All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us.
We are not liable for any delays caused by circumstances beyond our control, e.g. general labour dispute, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in relief from damages and other measures.
If any such situation should arise, we shall inform you accordingly both at the beginning and the end of the period for the current situation. If the situation has lasted for more than two months, both parties are entitled to terminate the purchase with immediate effect
2 YEAR WARRANTY
A 2-year statutory warranty applies for all items you order from us.
This means that we will repair any manufacturing fault that is detected in our products within 2 years of purchase or replace the product.
This 2-year period starts on the day you receive your order.
We do not offer extra warranty on any product other than what the law has clearly implied. Neither can we guarantee that the quality of any products obtained by you will meet your expectations.
We reserve the right to discontinue any product at any time.
We strive our utmost best to source the best suited fabrics through our manufacturers and fabric suppliers for all our styles.
With the help of our manufacturer and fabric supplier we form a wash/care label with clear instructions for our customers to follow.
Nevertheless, we cannot assume liability for or guarantee in terms of wash/care, color loss/bleeding, shrinkage; or against fabric damage - especially to delicate and tender fabrics during any form of cleaning, washing, steaming or ironing.
The customer alone is responsible for damage that occurs during use and home care. Especially in case of failure to follow care instructions and further complicating a stain by using a home remedy, chemical damage from spillage, medications, cosmetics, perfumes, hair dyes and shrinkage of garments due to use of improper washing techniques.
